Budleigh Salterton Festival Limited is a company limited by guarantee (Company Registration Number 5277571) and a Registered Charity (Charity Registration Number 1107812) and is referred to in these Terms and Conditions as ‘BMF’.

1. GENERAL TERMS AND CONDITIONS

1.1 In purchasing tickets, ticketholders agree to accept BMF’s terms and conditions.

1.2 BMF reserves the right to cancel the advertised programme and to make changes to the programme or artists due to unforeseen or unavoidable circumstances outside its control. Ticketholders will be notified in advance of cancellation or changes where reasonably practicable.

1.3 BMF reserves the right to refuse admission or require ticketholders to leave the premises without a refund in the event of a ticketholder:

  • Causing disruption to other members of the audience or to artists
  • Behaving in an anti-social or threatening manner
  • Putting the safety of customers, employees or property at risk
  • Operating a phone, camera or recording equipment of any kind for an unauthorised purpose
  • Otherwise breaching these Terms and Conditions.

1.4 Mobile phones must be switched off before entering the auditorium and must not be used during the event.

1.5 BMF does not accept any responsibility for any personal property. Nothing in these Conditions is intended to limit or exclude BMF’s liability for personal injury or death caused by BMF’s negligence or for any other liability that cannot be excluded or restricted under the law of England and Wales. Subject to this, to the maximum extent permitted by law, BMF excludes any liability for loss, injury or damage to persons/property arising out of attendance at festival events.

1.6 Ticketholders with mobility issues can be accommodated. There are accessible toilets nearby. All venues have step-free access. All venues can accommodate a limited number of wheelchairs. Wheelchair spaces must be requested when booking.

1.7 A responsible adult (over 18) must accompany children under 14. Each responsible adult can accompany a maximum of 6 children. Children over 14 may attend alone but must be delivered and collected by a responsible adult (over 18) and are not the responsibility of BMF.

1.8 Unauthorised photography or use of audio or video recording equipment including mobile phones is forbidden.

1.9 Some festival events may be filmed and/or recorded. By buying a ticket ticketholders are deemed to give consent to be filmed and/or recorded as a members of the audience.

1.10 Only drinks and food supplied by BMF or its agents are permitted at festival events.

1.11 Smoking, including e-cigarettes and personal vaporisers, is prohibited at all festival events.

1.12 Festival events are operated on a Covid-secure basis in accordance with applicable government guidelines and ticketholders are required to comply with the measures in place from time to time.

2. TICKET SALES
Tickets are sold through an external agency online and by phone. The online booking link and phone number are in our brochure and on our website.

2.1 Tickets are non-refundable and cannot be exchanged.

2.2 A valid ticket must be presented to enter a festival event. This can be a conventional ticket, a printed e-ticket or an e-ticket on a mobile device.

2.3 In the event of cancellation by BMF, a refund of the face value of the ticket will be made by the ticket agency.

2.4 All concert seats are reserved. BMF reserves the right to change seat allocations. Seats sold with a restricted view will have visibility of screens showing live streaming of the event.

2.5 Latecomers will only be admitted at a suitable pause in the performance.

3. WEBSITE TERMS OF USE
www.budleighmusicfestival.co.uk is a website owned by BMF. By using our website, you confirm that you accept these terms of use and that you agree to comply with them. We amend these terms from time to time. Every time you wish to use our website, please check these terms to ensure you understand the terms that apply at that time. If you do not agree to these terms, you must not use our website. We recommend that you print a copy of these terms for future reference.

The term BMF or “us” or “we” refers to the owner of the website. The term “you” refers to the user or viewer of our website.
These terms of use refer to the Privacy Policy, which also applies to your use of our website. We will only use your personal information as set out in our Privacy Policy.

3.5 Unauthorised use of this website may give rise to a claim for damages and/or be a criminal offence. You may not create a link to this website from another website or document without our consent.

3.6 Your use of this website and any dispute arising out of such use of the website is subject to the laws of England and Wales.

3.7 Through this website you are able to link to other websites which are not under the control of BMF. We have no control over the nature, content and availability of those sites.
